1.    APPLICABILITY OF THIS PRIVACY NOTICE

Automobili Lamborghini S.p.A. (“Lamborghini SpA”) and Automobili Lamborghini America, LLC (“ALA” and, together with Lamborghini SpA “Lamborghini,” “us,” “we,” and “our,” as the context may require) are committed to protecting the privacy of your personal information.

This General Privacy Notice (this “Privacy Notice”) is being provided so that we can provide you with information about our information collection and use practices. This Privacy Notice covers all information collected and used by Lamborghini as follows:

  • Information that we collect from you when you visit the websites we own and operate, including www.lamborghini.com and www.lamborghiniallaccess.com (throughout this Privacy Notice, we refer to these sites, along with any other websites we may own and operate, as the “sites”);
  • Information that you submit to us through the sites, including through any “Contact Us” or similar feature;
  • Information that you submit to us when you contact us by telephone through our Contact Center;
  • Information that you submit to us when you sign up for our newsletter or similar communications;
  • Information that you or others provide to us when you sign up for, register for, pay for, and/or participate in any event that we sponsor or co-sponsor;
  • Information that you or others provide to us when you borrow a Lamborghini-branded vehicle pursuant to one of our authorized loan programs;
  • Information that is provided to us in connection with your interest in, purchase of, or servicing of a Lamborghini-branded vehicle from or at an authorized Lamborghini dealer; and
  • Information that you or others provide to us when you use Lamborghini assistance services such as Lamborghini roadside assistance.

Certain of our vehicles include hardware and software that provide connected car services (“Connected Services”). If you use our Connected Services, you should also refer to the Connected Services Privacy Policy for your vehicle, which can be accessed through your vehicle’s Connected Services dashboard.

The Connected Services Privacy Policy applicable to your vehicle will provide additional information about how we collect, use, and share information collected through the Connected Services.

In addition, we offer a mobile application that works with the Connected Services called the Unica App. We may from time to time offer other mobile applications that provide our customers and others with additional functionality and features, such as our Track & Play App. These and any other such mobile applications will be subject to additional privacy notices included with the application.
 

2.    THE CATEGORIES OF INFORMATION WE COLLECT

As part of doing business, Lamborghini collects and processes personal information. Personal information refers to information that we can use to personally identify a specific individual. Different states and countries define personal information (and similar terms, such as personal data, personally identifiable information, and PII) to include different things, but it generally includes information like your name, mailing address, e-mail address, and phone number. It may also include your computer or mobile device IP address, if that IP address can be linked to a particular person, or geo-location information, if that information can be used to pinpoint a specific person.

Below, we identify the categories of personal information we collect, including examples of the type of information we collect within those categories. We present the information below based on the categories of information collected, but similar specific pieces of information may apply to multiple categories. We also provide information about our legal basis for processing the information.

3.    THE SOURCES OF PERSONAL INFORMATION WE COLLECT

  • Directly from you when you interact with us, including in person, over the phone, and via online activity, such as signing up for our newsletters, using the “Contact Us” feature of our website, and signing up to participate in our events;
  • From our dealership network, when you purchase products and services, participate in test drives, or otherwise express interest in Lamborghini products and services;
  • From our Contact Center;
  • Indirectly from you through your use of vehicles with telematics capabilities, such as our Connected Services, or our mobile applications;
  • Indirectly via our internal production systems;
  • Indirectly through cookies and online technologies and through the use of third-party analytics; and
  • Indirectly from our third-party service providers, who may provide information and services (such as payment processing services, roadside assistance, event planning and customer service surveys and support) on our behalf.

We may combine information that we receive from the sources identified above and use it for business and commercial purposes as described in this Privacy Notice.


4.    HOW WE USE PERSONAL INFORMATION

We use the personal information we collect for the following business and commercial purposes:

  • To process orders for and deliver vehicles;
  • To manage our relationship with vehicle owners;
  • To communicate with and provide services to our customers and prospective customers;
  • To respond to your questions and requests such as requests for product information;
  • To perform and record warranty service;
  • To provide notice of recalls or service actions;
  • To coordinate event participation, vehicle loans, and vehicle test drives;
  • To provide Connected Services (including access to any associated mobile application(s));
  • To understand website usage patterns and behavior;
  • To provide, support, personalize, and develop our website, products, and services;
  • To evaluate and improve our customer experiences;
  • To engage in research and development and run technical campaigns;
  • For data enrichment and to understand our customer and prospect base;
  • To manage vehicle ownership history and conduct reporting;
  • To engage in promotional or marketing efforts (subject to your consent or opt-out rights, as required by law);
  • To create, maintain, customize, and secure your account with us; and
  • To personalize our interactions with you, such as by providing preferred language usage and country-specific information regarding fuel consumption, emissions, and homologation for the duration of Connected Services sessions.

In addition to the business or commercial purpose of collection of personal information described above, we may use any of the personal information we collect for the following purposes:

  • To prevent transaction or user fraud, and to help maintain the safety, security, and integrity of our site, Connected Services, and business;
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations;
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets in which personal information held by use about our website users is among the assets transferred; and
  • As otherwise described to you when collecting your personal information.


As noted above, we may use your personal information to engage in direct marketing efforts (such as sending promotional materials, either electronically or through the mail). Before we do so, where required by law, we will seek your express opt-in consent to do so at the time we collect your information. If you have opted in to receiving our marketing materials, you will have the opportunity to revoke your consent at any time by contacting us. Please note, that if you do not opt in, or if you revoke a prior consent, we will undertake to honor your request, and will designate the restriction in our customer database. However, please note that we are only responsible for marketing materials directly sent by us – Lamborghini – and not for marketing materials relating to the Lamborghini brand that may be sent by third parties, including our dealers. If you do not want to receive marketing materials from those parties, you will need to contact the third party directly.

We will not use the personal information we have collected for any materially different, unrelated, or incompatible purposes not disclosed in this Privacy Notice without providing you notice and, if required by law, the opportunity to consent to such use.


5.    HOW WE SHARE PERSONAL INFORMATION

We may share personal information as follows:

  • Lamborghini SpA and ALA share information in order to manage customer and prospect relationships and for other business purposes consistent with those disclosed above.
  • We share information with Lamborghini dealers for sales and customer service purposes and for other business purposes consistent with those disclosed above.
  • We share information with our service providers (who are not considered third parties for purposes of the CCPA), such as our contact center, in the ordinary course of our business relationships with those parties. This may include disclosure to companies belonging to the Volkswagen-Audi group, to which Lamborghini belongs, and/or Lamborghini’s sales and service network (such as branches, importers, distributors, dealers, service centers, banks, and insurance companies) and/or our program and event partners.
  • For Connected Services, we share personal information with the service providers providing both the telematics services and the requested services (such as Agero for roadside assistance, or Spotify and Amazon for infotainment applications).
  • We share information with analytics providers (such as Google Analytics) so they can help us evaluate our websites’ performance.

When we disclose personal information to third parties in the circumstances noted above, we enter into agreements with those third parties that describe the purposes for which the personal information may be used and that require the third party to keep that personal information confidential.

We will also share information as necessary to respond to law enforcement requests and as required by applicable law, court order, or governmental regulations. And, if we engage in a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets in which personal information held by us about our website users is among the assets transferred, we will share information with the acquiring/successor company.

Currently, certain browsers, including Firefox, Google Chrome, Safari and Internet Explorer, offer a “do not track” (DNT) option.
